Competence in commercial and criminal law

Business Law

As a specialist in business law, I support you when you start, reconstruct or liquidate your company. I advise you in all legal matters in everyday business and make sure that you operate legally safe in larger projects such as acquisitions.

Through my years of experience as a litigator, I navigate you safely through the jungle of red tape, for example when it comes to competition law, to matters of trademark and copyright protection or with regard to labour law.
Contact me with questions about

  • Corporate and Company Law

To be successful with your business, you need a clear structure and an efficient organization. Choosing the right form of society and the correct definition of the business processes are therefore prerequisites for long term successful work.

I advise and support you in all matters related to the subject of company law, as

    • Re-establishment, restructuring and liquidation
    • Commercial and company law
    • Purchase and sale of companies or parts of companies
    • Due diligence
    • Directors' liability
    • Succession planning
    • D & O Liability
    • Corporate housekeeping
  • Commercial Law

With today's laws and regulations, it is generally not easy for companies to keep track of all legal limits and opportunities. This particularly applies to commercial law. To play safe, I support you in a wide range of topics, i.e.

    • Creation and control of Conditions of Use
    • IT and e-commerce issues
    • Financing and restructuring measures
    • Sales and cooperation agreements
    • Confidentiality agreements
    • Regulatory issues (FINMA, SRO etc.)
  • Contract Law

Whether you are private person or a company: Nowadays, anyone is confronted with contracts of all kinds. A clean, contractual regulation of all party interests brings clarity and certainty and ultimately helps prevent disputes.

I advise you in the preparation and control of a variety of types of contracts such as

    • Purchase agreements of all kinds
    • Work contracts
    • Shareholders' agreements
    • Rental and lease agreements
    • Loan agreements
    • Distribution agreements
    • Leasing and franchise agreements
    • License agreements
    • Transport contracts
  • Employment Law

In today's working environment, you will inevitably be faced with labour issues, whether as an employee, employer or HR manager of a company. Issues such as employment contract, dismissal, illness, overtime, etc. can be multifaceted and complex – and require clear and substantiated answers. Note that in these fields, special sensitivity is required, because the individual person is at the centre of the focus.

The following topics of Employment Law are part of my field of activity:

    • Creation and control of employment contracts
    • Development of employee regulations and expenses regulations
    • Creating Privacy Policies
    • Check dismissals
    • Elaboration of resolution agreements
    • Consulting Outsourcing and Staff Leasing; representation before the cantonal labour office
    • Obtaining residence and work permits
  • Intellectual Property / Competition Law

From idea to product: The Law of Intellectual Property protects human creation and enables their commercial use as product, brand, design or patent. The Competition Law hereby ensures that competition follows strict rules and that suppliers compete fairly in the fight for new clients. In the area of intellectual property, I support you, among others, in the following fields:

    • Advice on trademark protection strategies
    • Registration and acquisition of brands
    • Warning and procedure for trademark and copyright violations
    • Transfer and license agreements
    • Know-how and design protection

Competition concerns may turn around the following issues:

    • Testing of advertising campaigns and strategies
    • Examination of personality injuries
    • Warning of competitors and conducting litigation against competitors
  • Insolvency and Litigation

When disputes cannot be resolved by agreement, your only way to enforce your claim may be to go to court. The same goes if someone requires money from you and you believe that you owe nothing: You will have to take a stand, with the right steps at the right time.

In matters of insolvency and litigation, I support you especially in the following areas:

    • Implementation of attachment and bankruptcy
    • Arranging safety measures such as arrest etc.
    • Leading opposition, collocation and challenge processes
    • Litigation in all state courts
    • Enforcement of foreign judgments in Switzerland
  • Property

Buying a house or an apartment is a unique event for many – which requires that you check beforehand that your future home actually delivers what it promises. On the other hand, if you want to sell your property, you want to make sure that the broker is not the only one to profit in the end …

In real estate, I support you specifically in issues like:

    • Creation and verification of estate purchase contracts
    • Creation and verification of broker agreements
    • Execution of broker mandates
    • Advising foreigners concerning Swiss Regulations (Lex Koller)
    • Consulting and observing of legal interests in construction defects
    • Advisor to real estate management companies

Timely advice on business law saves money, time and nerves – and promotes long-term business success. Contact me by phone, +41 (0) 44 268 99 90, or e-mail.

Criminal Law

Criminal Law is often referred to as the most effective weapon of the state – and this quite rightly: house searches, detention and interrogation are digging deep into a person's rights and create fear of the future. Victims of crimes and people who have suffered damage are often unsure of the legal process and lack knowledge about their possible claims for damages. In both situations, I strongly recommend that you consult a professional.

In criminal law, I support victims, people whose rights have been violated and perpetrators in the following areas:

  • White Collar Criminal Defence
  • General Criminal Law
  • Violent crimes
  • Offenses of supplementary law (i.e. competition, copyright, etc.)

Make sure you get professional support when the going gets rough – especially, when a prosecutor is involved: You’re worth it! Contact me by phone, +41 (0) 44 268 99 90, or e-mail e-mail.
